He was the son of Peter Diack and Anne Leys.

He married Margaret Ann Gilmore on 25 Jul 1867 at Caledonian Hotel, cnr. Walker and Hope Strs, Dunedin, Otago, New Zealand.

They had 6 children: William Alexander Diack, Robert Gordon Diack, James Peter Diack, Jane Gilmore Diack, John Cushney Diack and George Gilmore Diack.

He died on 1 Jun 1907 at Hillhead, Waikouaiti, Hawksbury, Otago, New Zealand at the age of 71.
