He married Margaret McPherson on 26 Dec 1863 at Rayne, Aberdeen, Scotland. She was born on 9 Feb 1842 at Kintore, Aberdeenshire, Scotland. She died on 16 Nov 1911 at Congleton, Old Rayne, Aberdeenshire, Scotland at the age of 69.

They had 4 children: Annie Ley Diack, James Diack, Agnes Diack and Barbara Mary Diack.

He died on 14 Oct 1897 at Kirktown, Old Rayne, Aberdeenshire, Scotland at the age of 71.
