He was the son of James Foote and Agnes Forbe.

He married Christian Cumming on 1 Jul 1848 at Kinnellar, Aberdeenshire, Scotland. Christian was the daughter of Jonathan Cumming and Christiana Marr. She died on 31 Oct 1899 at Barnyards, Gordon's Mills, Aberdeen, Scotland.

They had 9 children: James Foote, Isabella Foote, Christian Foote, Mary Maxwell Foote, John Foote, Martha Marr Foote, Alexander Foote, Margaret Foote and Annabella Foote.
